Fibromyalgia and Long Term Disability Claims

Fibromyalgia is normally diagnosed by a rheumatologist.  Patients report widespread pain.  Some common symptoms include tiredness, chronic pain, stomach and bowel issues and insomnia.

Long term disability insurance companies often question the diagnosis of fibromyalgia and argue that the symptoms have no objective basis. Disability insurers may argue that you have insufficient medical evidence or that you can do some sort of sedentary work.

Further, disability carriers often try to deny claims for fibromyalgia on the basis that you have a pre-existing condition.

If you have fibromyalgia and your long term disability insurance company has denied your disability claim you should retain a disability lawyer.  Your lawyer will obtain records from your treating doctors and seek an opinion from a specialist about whether you can work.  It may be necessary to obtain a report from a functional capacity assessor or a vocational expert.

Your disability lawyer will sue the insurance company and work towards a strong and timely resolution of your claim.

At Kotak Law we represent people with Fibromyalgia who have been denied disability benefits. We work tirelessly on our clients’ behalf. We are approachable and will guide you through the entire process.
