Stress at Work and Disability Claims

There are a number of causes of workplace stress. You may have or experience one or more of the following situations:

  • a toxic work environment
  • an unreasonable or abusive boss
  • much too much work than you can handle
  • unsupportive supervisors or coworkers
  • unreasonable demands
  • bullying, gossiping or humiliation

You can apply for short and long term disability benefits if the workplace stress results in you being unable to continue working. It is important that you make your family doctor aware of the stress at work. Your doctor would have to provide you with an initial note explaining that you cannot continue to work.

You would then file a claim for disability benefits and your doctor will be asked to fill out a physician’s statement detailing your symptoms and the impact on your function.

You should also exercise your right to apply for employment insurance sick benefits. Additionally, you may have a claim for constructive dismissal.

We recommend consulting with a disability claim lawyer who could give you the appropriate advice during the process and assist you if your claim for short term or long term disability benefits is denied.
